Employment Discrimination

California Lawyers Protecting Employees from Discrimination

Employees have the right to feel safe and comfortable at work. By law, workplaces are required to be free of discrimination and harassment. If you believe your employer has allowed discriminatory actions to take place against you, federal and state laws allow you to seek financial compensation.Employment Discrimination

At the Cifarelli Law Firm, LLP in Santa Ana, we provide legal counsel and representation for employees who experience discrimination, harassment or retaliation. Contact us to discuss your case with a member of our legal team.

Defining Employment Discrimination

Often, disagreements occur in the workplace and people feel mistreated. They may question whether their poor treatment is considered discrimination, and they call our firm to discuss the situation and learn more about their rights. Employment discrimination occurs when employers discriminate on the basis of a protected category. These categories, established by laws, include:

  • Race
  • Color
  • Religion
  • Age
  • Disability, including pregnancy
  • Sex/gender
  • National origin
  • Sexual orientation
  • Genetic information

Employers have the right to fire employees so long as their reason for doing so do not violate the law. Simply because an employer may not like an employee does not, necessarily, give rise to a discrimination claim. The question that must be answered is why was the individual fired. In instances where a person applied for employment but was turned down, the question to be answered is why the individual was not hired.

Retaliation is Unlawful

The law protects employees who engage in protected activity at work from suffering retaliation. Protected activity might include reporting violations of law, such as harassment or discrimination in the workplace, and participating in a good-faith based law suit against the employer. Retaliation might come in the form of bad performance evaluations, unfavorable job assignments and, ultimately, termination. If you believe you may have suffered retaliation in the workplace, contact us for a confidential consultation about situation. We charge no fee, unless we accept your case and obtain compensation for you.
